These Terms & Conditions apply to the purchase of artwork, commissioned artwork and related services provided through this website and directly by the artist.

By enquiring about, purchasing or commissioning artwork, you acknowledge and agree to the following terms.
 

1. Artwork
 

All artwork displayed on this website is created by the artist and is presented for viewing and enquiry purposes. Colours, textures and details may appear slightly different depending on your screen, device or lighting.
 

Each original artwork is unique and may contain natural variations in texture, brushwork, colour and finish. These characteristics are part of the nature of original artwork and are not considered defects.
Artwork availability may change without notice.
 

2. Purchasing Artwork
 

Artwork is not purchased directly through this website. If you are interested in purchasing a piece, please contact me directly.
 

Once an artwork has been agreed upon for purchase, payment details, collection or delivery arrangements will be provided directly to you.
 

Artwork will generally only be released once payment has been received in full, unless otherwise agreed in writing.
 

3. Commissions
 

I accept commissions
 

A commission will be discussed and agreed upon before work begins, including the artwork concept, approximate size, colour palette, subject matter, timeframe and price.
 

A non-refundable deposit is required before work commences. The deposit secures your commission and allows materials, time and resources to be allocated to your artwork.

The remaining balance is payable upon completion and prior to collection or delivery, unless otherwise agreed.
 

Commission Variations
 

Commissioned artworks are individually hand-painted and created specifically for each client. As a result, commissioned pieces will not be identical to reference images, previous artworks or examples, but will be created to closely reflect the agreed concept, style, colour palette and overall design.
 

Minor variations in composition, brushwork, colour, texture and detail are to be expected and form part of the uniqueness of a handmade original artwork.
 

4. Changes to Commissions
 

Once a commission has been approved and work has commenced, significant changes to the agreed concept may result in additional costs or an adjustment to the completion timeframe.

Changes requested after substantial work has commenced may not always be possible.

Any additional costs will be discussed with the client before proceeding.
 

5. Cancellation of Commissions
 

Once a commission has been confirmed and the deposit has been paid, the deposit is non-refundable, as it covers time, preparation, materials and the allocation of the artist's availability.

If a client wishes to cancel a commission after work has commenced, any remaining balance or costs will be assessed based on the stage of completion and materials already used.
 

If the artist is unable to complete a commission for reasons within the artist's control, the client will be contacted and an appropriate resolution will be discussed.
 

6. Refunds and Change of Mind
 

Due to the individual and custom nature of original and commissioned artwork, change-of-mind refunds are not offered
 

This does not exclude or limit any rights you may have under applicable Australian Consumer Law. Where an artwork or service does not meet a consumer guarantee that cannot legally be excluded, your rights under Australian Consumer Law will continue to apply.
 

7. Payment
 

Payment arrangements will be provided directly to the client.
 

For original artwork purchases, full payment is generally required before the artwork is released for collection or delivery.
 

For commissioned artwork, the required deposit must be paid before work begins, with the remaining balance due upon completion and before collection or delivery, unless otherwise agreed.
 

8. Delivery and Freight
 

Shipping, delivery and freight costs are not included in the artwork price unless specifically stated.
 

Where delivery is required, the cost will depend on the artwork's size, weight, destination and the delivery service required.
 

The client is responsible for approved delivery or freight costs unless otherwise agreed.

For larger or particularly fragile artworks, specialist art transport may be required.
Any additional freight or handling costs will be discussed with the client prior to delivery.

Once artwork has been handed to an agreed third-party courier or freight provider, delivery times are outside the artist's control.
 

9. Collection

Local collection may be available by appointment.
 

Collection arrangements will be confirmed directly with the client once payment has been received.
 

The client is responsible for ensuring they have suitable transport and appropriate protection for the artwork where they are collecting it themselves.
 

10. Damage During Delivery
 

All artwork will be packaged with reasonable care before dispatch.

If an artwork is damaged during transit, the client should contact the artist as soon as possible and provide photographs of the artwork and packaging.
 

Where a third-party courier or freight provider is responsible for the damage, the artist may assist the client in communicating with the delivery provider. Any available claims will be subject to the terms and conditions of the relevant delivery provider.
 

11. Artwork Ownership and Copyright
 

Payment for an original artwork transfers ownership of the physical artwork to the purchaser. It does not transfer copyright or reproduction rights.
 

All copyright and intellectual property rights in the artwork remain with the artist unless otherwise agreed in writing.
 

The artwork may not be reproduced, copied, commercially exploited or used to create derivative works without the artist's written permission.
 

The artist may photograph completed artworks and use images of commissioned or purchased works for portfolio, website, social media, exhibition and promotional purposes, unless otherwise agreed with the client.
 

12. Artwork Care

The purchaser is responsible for appropriately caring for and displaying the artwork after collection or delivery.
 

Artwork should be kept away from excessive moisture, direct sunlight, extreme temperatures and other conditions that may cause damage or deterioration.
 

13. Website Information
 

Every effort is made to ensure that information, artwork descriptions, dimensions, pricing and availability displayed on the website are accurate and current.
 

However, minor errors or changes may occur. The artist reserves the right to correct information or update artwork availability without notice.
 

14. Privacy
 

Personal information provided when making an enquiry, purchasing artwork or commissioning a piece will be handled in accordance with the Privacy Policy available on this website.
 

15. Changes to These Terms
 

These Terms & Conditions may be updated from time to time. The most current version will be published on this website.
 

By proceeding with an artwork purchase or commission, you acknowledge that you have read and accepted the Terms & Conditions applicable at the time of your purchase or commission.
